Paddock Cleaner UK is operated under Fresh Group Products Limited which is a trading name under Fresh Group Limited. Any references to "Fresh Group" or "Fresh Group Limited" in these terms apply to both entities. By purchasing on this website, you agree to the terms and conditions outlined below.

1. General Terms

All goods, equipment, or spare parts (collectively referred to as "the equipment") supplied by Paddock Cleaner UK are subject to these terms unless explicitly agreed in writing by a director of Fresh Group Products Limited.

Buyer’s terms and conditions are excluded unless expressly accepted in writing.

2. Price and Payment

Price Adjustments: Prices may be updated before delivery due to supplier cost changes, currency fluctuations, taxes, or new legislation.

Deposit: A non-refundable deposit of up to 20% may be required when placing an order. This deposit is offset against cancellation charges (see Clause 9).

Final Payment: Full payment is due before delivery unless otherwise agreed in writing.

Late Payment Penalty: Overdue payments may incur an interest charge of 4% per annum above the prevailing minimum lending rate.

Default: Failure to pay on time may lead to contract cancellation, refusal of future deliveries, and claims for losses incurred.

3. Delivery

Delivery Signatures: Deliveries require a signature upon receipt. If unavailable, a neighbour may sign with prior written authorization from the buyer provided the customer has emailed written instructions of the signing neighbour.

Re-delivery Charges: If an authorized recipient isn’t available to receive the delivery, charges for re-delivery will apply, at cost.

Insurance: Buyers are responsible for obtaining postal or delivery insurance, as Paddock Cleaner UK cannot be held liable for lost or damaged goods without such cover.

Inspection/Damaged Goods: Goods must be inspected at delivery. If damaged and the damage is minor and willing to accept and repair/fit parts to be supplied from the manufacturer, this must be recorded on the delivery paperwork and reported within 24 hours to qualify for claims/parts. If the damage is more severe then refuse the goods for return to the supplier/manufacturer for repair/replacement.

4. Ownership and Risk

Title Transfer: Ownership of the goods will transfer to the buyer only upon receipt of full payment.

Risk Transfer: Responsibility for the goods transfers to the buyer upon delivery.

Repossession Rights: If payment is overdue or the buyer becomes insolvent, the seller reserves the right to reclaim unpaid goods.

5. Force Majeure

Paddock Cleaner UK is not liable for delays or non-performance due to events beyond its control, including but not limited to natural disasters, strikes, governmental actions, or supplier delays.

6. Liability

Faulty Equipment: Faulty or defective items will be repaired or replaced if reported within 7 days of delivery for new products.

Second-hand Equipment: Liability for used or reconditioned items is limited to any warranties explicitly provided at the time of sale.

Indirect Losses: The seller is not responsible for indirect or consequential losses, including loss of profits.

7. Health and Safety

Buyers must ensure the equipment is used safely and complies with statutory requirements.

For second-hand or reconditioned items, buyers are responsible for ensuring the items meet health and safety standards.

8. Claims for parts missing/lost in transit

Documentation: Claims must include signed delivery paperwork detailing the issue and any photographic evidence to support the claim is useful to speed up the supply of parts.

9. Cancellation

Orders cannot be cancelled without compensating the seller for any losses incurred. A minimum cancellation fee of 20% of the order value applies.

10. Governing Law

All contracts and disputes arising from these terms and conditions will be governed by and interpreted following the laws of England.

11. Warranty

Coverage: A return-to-base manufacturer’s warranty applies to new products. Buyers are responsible for return costs.

Conditions: The warranty may be voided if proper servicing, regular checks and maintenance procedures have not been followed.
